Terms of Use

Effective: [Effective date]Last updated: September 2026

The rules for using LossKeeper, a free tool for organizing your own property insurance claim. Businesses listed in the directory should also read the Listing terms for businesses.

The short version

  • LossKeeper is an organizing tool. It is not a public adjuster, law firm, insurer or insurance agency. It does not represent you, give advice, or value, interpret or negotiate your claim.
  • Your file is yours. You are responsible for what you enter and for anything you send to your insurer.
  • Keep a backup. Without an account, your file exists only in this browser.
  • Listings are not endorsements. Featured listings are paid advertising and are always labeled. Check licenses and insurance before you hire.
  • You hire and pay businesses directly. LossKeeper takes no commission and no per-lead fee.
  • LossKeeper is free and provided as-is, with limits on our liability described below.

Agreeing to these terms

These Terms of Use are an agreement between you and [LossKeeper LLC] (“LossKeeper,” “we,” “us”), [mailing address]. By using LossKeeper you agree to them. If you do not agree, do not use LossKeeper.

Our Privacy Policy explains how we handle your information and is part of these terms.

What LossKeeper is — and is not

LossKeeper helps you keep your own records: a claim log, photos, estimates and payments, living expenses, a contents inventory, documents, a printable report, and a directory of specialists.

LossKeeper is not a public adjuster, law firm, insurer or insurance agency.

  • It does not represent you or act on your behalf with your insurer or anyone else.
  • It does not give legal, insurance, tax or financial advice.
  • It does not value, interpret, evaluate, present or negotiate your claim, and does not interpret your policy.
  • Using LossKeeper does not create an attorney–client, adjuster–client, broker–client or any other professional relationship.

Category descriptions, checklists and other general information in LossKeeper are general in nature and may not fit your policy or situation. Your policy and the law set your rights and deadlines. For advice about your claim, consult a licensed professional of your choice.

Founder disclosure

[Founder disclosure — confirm wording with counsel]

LossKeeper was founded by [Founder name], a public adjuster licensed in California. LossKeeper is owned and operated by [LossKeeper LLC], a company separate from any public adjusting firm. LossKeeper does not refer users to the founder’s public adjusting firm, [founder’s firm], and does not share user information with it. That firm does not appear in the LossKeeper directory and pays nothing to LossKeeper. The founder does not act as anyone’s public adjuster through LossKeeper, and using LossKeeper creates no relationship with the founder or his firm.

Eligibility and accounts

  • You must be at least 18 years old to create an account.
  • You may use LossKeeper for your own claim, or for a claim you are authorized to manage (for example, for a family member or a business you work for).
  • Keep your password private. You are responsible for activity on your account. Tell us promptly at support@[losskeeper domain] if you think it has been misused.

Your claim file and your content

  • You own your content. Everything you enter or upload stays yours.
  • Limited permission to us. If you create an account, you allow us to store, copy and transmit your content only as needed to run LossKeeper for you — for example, to back it up, sync it, send a contact request you asked us to send, or let our support staff view it (read-only) to help you. This permission ends when you delete the content or your account, subject to the backup purge period in the Privacy Policy.
  • You are responsible for your content. Make sure you have the right to upload it, and that what you record is accurate. Do not upload anything unlawful.

Local storage, backups and deletion

  • LossKeeper stores your file in your browser on your device. If you have no account and your browser data is cleared, your device is lost, or the app is uninstalled, your file is gone. Export a backup regularly.
  • An optional account keeps a backup online and syncs it across devices. Syncing can fail or be delayed; keep your own exports of anything important.
  • “Start over” permanently erases the file on this device and, if you are signed in, the online copy. Deleting your account permanently removes your account and online data. We cannot recover either.

Reports and exports

The PDF report and JSON backup organize what you entered. They are not a proof of loss, a claim submission, or a statement checked or verified by LossKeeper. LossKeeper does not send anything to your insurer. You decide what to share and are responsible for its accuracy.

AI drafting

“Draft my log entry” uses an AI model (Anthropic) to turn what you typed into a structured log entry. AI output can be wrong or incomplete. Review every draft; nothing is saved until you approve it, and once you save it, it is your entry. Do not rely on AI output as advice. Use of the feature is optional and subject to the Privacy Policy.

The specialist directory

  • Listings are not endorsements, recommendations or referrals. The choice of whether to hire anyone, and whom, is yours.
  • Some listings show a license number the business gave us; you can check it yourself with the licensing agency. If LossKeeper adds a verification badge, it will mean only that we checked a license, insurance, or certification at a point in time — not a guarantee of quality, current status, or fitness for your job.
  • Other businesses are self-listed and reviewed before publishing, but their credentials have not been verified to the same standard.
  • Verify before you hire. Check licenses yourself — for contractors in California, with the Contractors State License Board (CSLB) at cslb.ca.gov — and ask for proof of liability insurance and workers’ compensation coverage, and for references.
  • Suggested specialist categories come from what you record about your loss. No business can pay to change them.

Businesses may pay LossKeeper a flat fee to appear in a “Featured” group within a directory category. Featured placement is paid advertising. It is always labeled “Featured.” It buys position in the list and nothing else: it never changes the categories suggested to you, the general information shown, what your file suggests as next steps, or how a business’s credentials are described.

LossKeeper receives no commission, referral fee, per-lead fee or share of what you pay any business. Placement fees are flat and do not depend on whether you contact or hire anyone.

Asking a business to contact you

If you tap to request contact and confirm, we send your name, email, phone and a short claim summary to the one business you chose. Contact requests require an account. Only send requests to businesses you want to hear from. After that, the business contacts you directly; LossKeeper is not part of the conversation. You can tell a business to stop contacting you at any time. Report misuse to support@[losskeeper domain].

Hiring a business

Any agreement you make with a business is between you and that business. You contract with and pay it directly. LossKeeper is not a party to that agreement and is not responsible for any business’s work, advice, pricing, conduct, licensing or insurance.

Acceptable use

Do not:

  • use LossKeeper to create false or misleading claim records, or for any fraudulent or unlawful purpose;
  • upload malware, or try to access another person’s data or our systems without permission;
  • send contact requests in someone else’s name or without their permission;
  • scrape the directory or use it to send unsolicited marketing;
  • interfere with LossKeeper’s operation or overload it.

Price

LossKeeper is free for policyholders. If we ever offer paid features, we will tell you the price before you are charged, and the features described in these terms will not become paid without notice.

Third-party services

LossKeeper relies on third-party services (listed in the Privacy Policy) and may link to outside websites. We are not responsible for outside websites or for a listed business’s services.

LossKeeper’s property and feedback

LossKeeper’s software, design, name, logo and written content belong to [LossKeeper LLC] or its licensors. You may use LossKeeper for its intended purpose; you may not copy, resell or reverse engineer it except as the law allows. If you send us suggestions, we may use them without obligation to you.

Disclaimers

LossKeeper is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that LossKeeper will be uninterrupted, error-free or free of data loss, or that using it will produce any claim outcome.

Limitation of liability

To the fullest extent the law allows, LossKeeper and its owners, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, or the outcome of any insurance claim, arising from your use of LossKeeper or any listed business. Our total liability for any claim relating to LossKeeper is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.

Some laws do not allow these limits, so they may not all apply to you. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

To the extent the law allows, you agree to cover LossKeeper’s reasonable losses and costs from third-party claims caused by your unlawful use of LossKeeper or your violation of these terms.

Ending your use

You may stop using LossKeeper at any time, use “Start over,” or delete your account. We may suspend or close an account that violates these terms, with notice where practical, and we will give you a reasonable chance to export your data unless the law or safety prevents it. We may change or discontinue LossKeeper; if we discontinue online accounts, we will give account holders at least [30] days’ notice to export their files. Sections that by their nature should survive, including disclaimers and limits of liability, survive.

Governing law and disputes

These terms are governed by California law, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally.

[Dispute resolution — counsel to decide: exclusive venue in the state and federal courts of [County] County, California, or individual arbitration with a small-claims option and class-action waiver.]

Changes to these terms

We will post updated terms here and change the “Last updated” date. For a material change, we will show a notice in the app and email account holders at least [30] days before it takes effect. Continuing to use LossKeeper after that date means you accept the updated terms.

General terms

These terms, the Privacy Policy and, for businesses, the Listing terms below are the whole agreement between you and LossKeeper about their subject. If a provision is unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver. You may not transfer these terms; we may transfer them as part of a merger, acquisition or sale of assets.

Listing terms for businesses

These terms apply to any business that lists itself in the LossKeeper directory, including through the business listing portal, in addition to the terms above. “You” here means the listed business and the person listing it, who confirms they are authorized to bind the business.

Accurate information

Everything in your listing — business name, contact details, license numbers, insurance, service areas, categories and description — must be true, current and not misleading. Update it promptly when anything changes.

Licensing and insurance

  • You represent that you hold every license, registration and certification the law requires for the services you list, in each area you serve — including, for contracting work in California, an active CSLB license in the correct classification.
  • You represent that you carry the insurance the law and your listing describe, including general liability and, where required, workers’ compensation.
  • You will notify us within [10] days if a license or policy lapses, is suspended or restricted, or becomes subject to disciplinary action.

Verification and removal

We may verify any information you provide — for example, by checking public license records or asking for a certificate of insurance — and may ask for documents. We may decline, suspend, edit for accuracy or remove a listing at our discretion, including for inaccurate information, a lapsed license or policy, user complaints, or a violation of these terms. A “credentials we confirmed” badge reflects a check at a point in time and may be removed if we cannot re-confirm it.

No guaranteed leads

We make no promise about how often your listing is shown, how many contact requests you receive, or whether any user hires you.

Featured placement

Featured placement is paid advertising and is always labeled “Featured” to users. It buys position within a directory category and nothing else. It never changes the categories suggested to users, the general information shown, what a user’s file suggests as next steps, or how your credentials or verification status are described.

Fees

Placement fees are flat, disclosed to you in writing before you agree, and listed in [fee schedule]. LossKeeper charges no per-lead fee, commission, referral fee or revenue share, and will not accept payment tied to whether a user contacts or hires you. [Refund terms for prepaid placement.]

Reviews and endorsements

Do not post, buy or solicit fake or misleading reviews or testimonials, review your own business, or offer incentives for reviews without clear disclosure, consistent with the FTC’s rule on consumer reviews and testimonials. Do not claim or imply that LossKeeper, any insurer or any public agency endorses or recommends you.

Handling contact requests

  • Use a user’s information only to respond to that user’s request about their claim.
  • Do not sell, share or rent it, add it to marketing lists, or use it for unrelated offers.
  • Follow the CAN-SPAM Act, the Telephone Consumer Protection Act and applicable state law. Do not place autodialed, prerecorded or artificial-voice calls or texts without the consent the law requires, respect Do Not Call rules, and stop contacting a user who asks you to.
  • Keep users’ information secure, and delete it when a user asks or when you no longer need it for the request or your legal obligations.

Listing changes and review

Changes to identity fields — business name, license number, contact email, service categories or ownership — send your listing back to review. Your listing, or its badge, may be hidden until the change is approved. Other edits may be published directly but remain subject to moderation.

Your relationship with users

You contract with and are paid by users directly. LossKeeper is not a party to your agreements and is not responsible for your work. You agree to cover LossKeeper’s reasonable losses and costs from third-party claims arising from your services, your listing content, or your handling of contact requests.

Ending a listing

You may remove your listing at any time by contacting support@[losskeeper domain]. We may end a listing as described above. Fees on ending are governed by [refund terms].
